Planning Beyond Ownership

Owning a firearm carries responsibilities that extend far beyond safe handling, regular training, and secure storage. One topic that is often overlooked is what happens to those firearms after the owner passes away. For many families, this can be an emotional and confusing time. Without a plan, loved ones may unknowingly violate state or federal law or fail to safely secure firearms while an estate is being settled.

GSG Learning Institute believes responsible firearm ownership includes planning for the future. Just as individuals prepare wills, trusts, and financial plans, they should also have a plan for the lawful transfer of their firearms.

The First Priority: Safety

The first step is ensuring every firearm is safely secured. If a knowledgeable person is available, firearms should be unloaded (if it can be done safely), stored in a locked container or safe, and kept inaccessible to unauthorized individuals. If no one in the family is familiar with firearms, contacting a licensed Federal Firearms Licensee (FFL) or local law enforcement for guidance may be the safest course of action.

Understanding the Legal Process

Firearms do not automatically transfer to family members simply because they were inherited. Federal law and state laws vary, and some states require transfers to occur through a licensed firearms dealer. The executor or administrator of the estate is generally responsible for ensuring the firearms are handled lawfully until they are transferred, sold, or otherwise disposed of.

Options Available to Families

  • Retain the firearms if the heir is legally eligible and all applicable transfer requirements are met.
  • Transfer the firearms to another eligible family member or individual using the appropriate legal process.
  • Sell the firearms through a licensed firearms dealer.
  • Temporarily store the firearms with an FFL while the estate is being administered.
  • Voluntarily surrender unwanted firearms to law enforcement where permitted.

Planning Ahead Matters

One of the greatest gifts a firearm owner can leave behind is a clear plan. Discussing your wishes with family members, maintaining an inventory of firearms, storing important records, and consulting an estate planning attorney can significantly reduce stress and uncertainty.
